Non-UK / Non-EEA Customers — Land-Only Travel Services

Important: These Booking Terms & Conditions apply only to customers who are not residents of the UK, EU or EEA and relate exclusively to land-only travel services. No international or domestic flights are sold or arranged by us.
By making a booking, you confirm that you are a non-EEA resident and that you have read, understood and accepted these Terms.
1. Definitions
"Company", "we", "us", "our" means TUTU VIEW Ltd, acting as organiser of land-only travel services.
"Booking" means the reservation of travel services confirmed by us in writing.
"Contract" means the binding agreement between you and us, formed when we issue a written booking confirmation.
"Guest", "you", "your" means each person named on the booking.
"Tour" or "Trip" means the land-only travel services confirmed in your booking, excluding flights.
"Trip Price" means the total price payable for the confirmed land-only services.
2. Scope of Services (Land-Only)
- (a) We provide land-only travel services, which may include accommodation, ground transportation, guides, activities and other services expressly listed in your booking confirmation.
- (b) Flights are fully excluded. We do not sell, arrange, ticket or take responsibility for international or domestic flights, nor for airline schedules, delays, cancellations, denied boarding or baggage issues.
- (c) Any flight arrangements you make are entirely separate from this Contract and are at your own risk.
3. Formation of Contract
- (a) A Contract comes into effect only when we issue a written booking confirmation.
- (b) The first named Guest confirms that they have authority to accept these Terms on behalf of all Guests and accepts financial responsibility for the Booking.
- (c) All pre-contract information, itineraries and quotations are indicative and non-binding until confirmed in writing.
4. Payments
- (a) A deposit and final balance may be required. The applicable amounts and payment deadlines will be stated in your booking confirmation.
- (b) Failure to pay any amount by the due date entitles us to treat the Booking as cancelled by you, with cancellation charges applying.
- (c) All payments are non-refundable except as expressly stated in our Cancellation & Refund Policy.
5. Changes Requested by You
- (a) Requests for amendments must be made in writing.
- (b) Amendments are subject to availability and supplier conditions and may incur additional charges.
- (c) Certain changes may be treated as a cancellation and re-booking.
- (d) We do not guarantee that any amendment can be accommodated.
6. Cancellation by You
- (a) Cancellations must be made in writing and take effect on the date received by us.
- (b) Cancellation charges are governed exclusively by our Cancellation & Refund Policy, which forms part of this Contract.
- (c) We strongly recommend comprehensive travel insurance.
7. Cancellation or Changes by Us
- (a) We reserve the right to make changes to the Tour due to operational, safety, supplier or Force Majeure reasons.
- (b) Minor changes do not entitle you to compensation or refunds.
- (c) If we cancel the Tour prior to departure for reasons other than Force Majeure or your breach, our liability is limited to refunding amounts paid to us for unused services, subject to supplier recoveries.
8. Trust Account and Monies
- (a) TUTU VIEW Ltd is a member of Protected Trust Services (PTS), membership number [PTS MEMBERSHIP NUMBER]. All monies received from customers are held in a PTS Protected Trust Account, ringfenced from our general business funds.
- (b) As a non-UK/EEA resident, the statutory insolvency protection afforded under the UK Package Travel Regulations does not apply to your booking. However, because your funds are held in the PTS trust account, they are ringfenced and benefit from the operational protections of that account.
- (c) By accepting these Terms, you acknowledge that statutory Package Travel Regulations insolvency protection does not apply to your booking, and you accept this position. We strongly recommend purchasing independent travel insurance that includes cover for supplier insolvency.
9. Travel Insurance
- (a) Adequate travel insurance is mandatory and is your sole responsibility.
- (b) Insurance should cover cancellation, curtailment, medical expenses, evacuation, personal liability, personal belongings and supplier insolvency.
10. Your Responsibilities
- (a) You are responsible for ensuring you hold valid passports, visas, permits and health documentation.
- (b) Failure to comply with entry, immigration or health requirements does not entitle you to any refund.
- (c) You must follow local laws, customs and instructions from guides and suppliers.
- (d) We reserve the right to terminate your participation without refund if your conduct endangers others or disrupts the Tour.
11. Activities and Assumption of Risk
- (a) Certain activities involve inherent risks.
- (b) You voluntarily assume all risks associated with participation in any activities included in or undertaken during the Tour.
- (c) You release us from liability for injury, illness, death or loss except where caused directly by our proven negligence.
12. Limitation of Liability
- (a) Our total liability for any claim (other than personal injury or death caused by negligence) is strictly limited to three (3) times the Trip Price.
- (b) We are not liable for indirect, consequential or business losses, loss of enjoyment or loss of opportunity.
- (c) Where services are provided by independent suppliers, their terms and liability limits apply.
13. Force Majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, governmental actions, strikes, or security risks.
14. Complaints
- (a) Any issue must be raised immediately with the relevant supplier and with us during the Tour.
- (b) Written complaints must be submitted within 30 days of completion of the Tour.
15. Governing Law and Jurisdiction
These Terms and any dispute arising from them are governed by English law, and the courts of England and Wales have exclusive jurisdiction.
16. Entire Agreement
These Terms, together with your booking confirmation and referenced policies, constitute the entire agreement between you and us.
