TUTU VIEW Ltd

These Booking Terms & Conditions ("Terms") apply to all bookings made with TUTU VIEW Ltd ("we", "us", "our"). They set out the contractual relationship between you (the "Traveller" or "Customer") and TUTU VIEW Ltd when you book travel services with us.

By confirming a booking and making payment, you acknowledge that you have read, understood and agreed to be bound by these Terms.

1. Company Details

TUTU VIEW Ltd is a company incorporated in England and Wales, with its registered office at:

6th Floor, First Central 200, 2 Lakeside Drive, London NW10 7FQ, United Kingdom.

For the purposes of the UK Package Travel and Linked Travel Arrangements Regulations 2018 (the "Package Travel Regulations"), TUTU VIEW Ltd acts as the Package Organiser.

2. Scope and Eligibility

2.1 These Terms apply exclusively to:

  • Travellers who are residents of the European Economic Area (EEA), Switzerland or the United Kingdom; and
  • Land-only travel packages (no international or domestic air transport is included).

2.2 Our services are intended for individuals aged 18 or over.

3. The Package Contract

  • 3.1 When you book with us, you are purchasing a package within the meaning of the Package Travel Regulations, consisting of a combination of travel services (such as accommodation, ground transport, guides and activities) arranged by TUTU VIEW Ltd.
  • 3.2 TUTU VIEW Ltd is responsible for the proper performance of the travel services included in your package, irrespective of whether those services are to be performed by third-party suppliers.

4. Booking and Payment

  • 4.1 A booking is confirmed only once we have issued a written booking confirmation.
  • 4.2 A deposit may be required to secure your booking. The applicable deposit amount and payment schedule will be specified at the time of booking.
  • 4.3 The balance of the booking price must be paid by the date stated in your booking confirmation.
  • 4.4 We reserve the right to cancel the booking if payment is not received by the due date, in which case cancellation charges may apply.

5. Price and Changes

  • 5.1 All prices are quoted in the currency specified in your booking confirmation.
  • 5.2 We reserve the right to make minor changes to the package at any time.
  • 5.3 If we are required to make a significant change to the main characteristics of the package before departure, you will be informed without undue delay and offered the choices required under the Package Travel Regulations.

6. Cancellation by the Traveller

  • 6.1 You may cancel your booking at any time prior to departure by giving written notice.
  • 6.2 Cancellation charges will apply in accordance with our Cancellation & Refund Policy, which forms an integral part of these Terms and is available on our website.

7. Cancellation or Changes by Us

  • 7.1 We may cancel the package if the minimum number of participants is not reached or due to unavoidable and extraordinary circumstances.
  • 7.2 In such cases, refunds and alternative arrangements will be handled in accordance with the Package Travel Regulations.

8. Financial Protection and Insolvency Protection

  • 8.1 TUTU VIEW Ltd is a member of Protected Trust Services (PTS), membership number [PTS MEMBERSHIP NUMBER]. PTS is a financial protection scheme for the UK travel industry, providing insolvency protection for customers.
  • 8.2 All monies paid by you in respect of your booking are held in a Protected Trust Account operated by PTS. These funds are ringfenced and protected in the event of our insolvency.
  • 8.3 In the event of our insolvency, PTS will ensure that:
    • monies held in the trust account are returned to you; or
    • where travel arrangements have commenced, reasonable arrangements are made to ensure completion of your trip, where possible.
  • 8.4 For further information about the protection provided by PTS, please visit www.protectedtrustservices.com.
  • 8.5 We also strongly recommend that you take out comprehensive travel insurance covering cancellation, medical expenses, personal injury, repatriation and any risks not covered by the PTS scheme.

9. Changes by the Traveller

  • 9.1 Requests to amend a confirmed booking are subject to availability and supplier approval.
  • 9.2 Amendments may result in additional charges or may be treated as a partial cancellation.

10. Performance of the Package and Assistance

  • 10.1 We are responsible for the proper performance of the travel services included in your package.
  • 10.2 If you experience any lack of conformity during the performance of the package, you must inform us without undue delay to allow us to remedy the issue.
  • 10.3 We will provide appropriate assistance to travellers in difficulty, as required by the Package Travel Regulations.

11. Limitation of Liability

  • 11.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, or for any liability which cannot be limited or excluded under applicable law.
  • 11.2 Subject to clause 11.1, our total liability shall be limited to a maximum of three times the total price of the package, except in cases of intentional misconduct or gross negligence.
  • 11.3 We shall not be liable for indirect or consequential loss, loss of enjoyment, or business losses, to the extent permitted by law.

12. Independent Suppliers and Activities

  • 12.1 Travel services included in your package are provided by independent third-party suppliers.
  • 12.2 Certain activities may involve inherent risks. Participation in such activities is at your own risk, and you are responsible for ensuring that you are medically and physically fit to participate.

13. Force Majeure

We shall not be liable for failure to perform or improper performance of the package due to unavoidable and extraordinary circumstances beyond our control.

14. Insurance

We strongly recommend that you take out comprehensive travel insurance covering cancellation, medical expenses, personal injury, and repatriation for the duration of your trip.

15. Data Protection

Your personal data will be processed in accordance with our Privacy Policy, which is available on our website and forms part of these Terms.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
